Feng* runs a stall at a weekly market. He has a physical disability and attends the market with his carer, Kitana. One day Kitana was involved in an incident at the market, and the market operator banned her from attending future markets.
Feng lodged a complaint of disability discrimination with ADNSW, saying he could not run his market stall if Kitana was unable to accompany him.
ADNSW notified the market operator of the complaint. The market operator did not agree that it had discriminated against Feng but agreed to withdraw the ban placed on Kitana. In conciliation they also agreed to reimburse Feng for the fees he had paid for the period when he was unable to operate his stall because of Kitana’s absence.
