Government responds to Crimes Amendment (Display of Nazi Symbols) Bill

Earlier this year, ADNSW provided a submission (PDF , 138.1 KB) on the Crimes Amendment (Display of Nazi Symbols) Bill 2021. In the submission, ADNSW supported the criminalisation of the display of Nazi symbols but raised concerns about the Bill’s proposed exemption process which would have seen the President of ADNSW needing to grant approval each time a Nazi symbol was displayed for legitimate purposes like education.
The NSW Government response acknowledged the strong support for the Bill's protective objectives as well as the challenges relating to the practical implementation of the proposed exemption process.
The NSW Government has committed to introducing a new Bill to criminalise the public display of Nazi symbols without a reasonable excuse, through legislation that will overcome the risks and shortcomings of the original Bill. This new provision will provide an additional safeguard to the existing protections in NSW against vilifying conduct.
