Signature affected by Multiple Sclerosis

December 2022

Syed* has Multiple Sclerosis which has affected his signature.

Syed needed to discharge his mortgage so his brother, who is also his power of attorney, provided the bank with all the documents required to do this.

The bank refused to discharge the mortgage because Syed’s signature did not match the signature they had on file for him.

The delays Syed faced with the bank meant that he was now facing penalties of a delayed exchange on the sale of his property.

Syed lodged a complaint of disability discrimination with ADNSW.

The complaint was resolved when ADNSW wrote to the bank about the complaint and the bank promptly processed the necessary documents and actioned the discharge of mortgage.
