Request to move roles declined

Malek* has a psychological disability and was employed by a retail store to greet customers as they entered. 

One day while working, Malek was confronted by a group of young men who threatened him with a knife. Malek was traumatised by this incident and requested to move to a different role in the store, such as assisting at the self-service checkouts. Malek’s request was declined, and he felt this was because of his disability.

Malek lodged a complaint of disability discrimination with ADNSW.

The retail store did not agree that Malek had been discriminated against because of his disability.

The complaint was resolved at a conciliation conference when the store agreed to pay Malek $10,000.
