Yù Míng* has cerebral palsy and uses a power wheelchair. She signed up for a series of treatments at a beauty clinic at significant cost. After the first two treatments, she felt that the clinic was providing her with services on less favourable terms and was taking advantage of her because of her disability.
Yù Míng lodged a disability discrimination complaint with ADNSW. ADNSW investigated her complaint.
During her treatments, Yù Míng said that she was asked intrusive questions connected to her disability, such as whether she was single, whether she had periods, and whether she could give birth. She also said the clinic tried to pressure her to sign up for more expensive treatments that she did not want. She decided to not have any further treatments and asked for a refund, but the clinic refused.
The clinic said that it did not unlawfully discriminate against Yù Míng. However, ADNSW was able to resolve the complaint by shuttle conciliation, when the clinic agreed to provide Yù Ming with a partial refund, which equated to substantial amount of money.
