Patrick* was in his eighties and employed in the education services sector. His employer started discussions with him about his position becoming redundant.
Patrick believed that his employer was using redundancy as an excuse to terminate his employment because of his age and perceived mental incapacity.
Patrick lodged a complaint of age and disability discrimination with ADNSW.
The matter was resolved in a conciliation conference. Patrick’s employer did not admit to discriminating against him but agreed that Patrick would resign from his position and they would pay him more than he would have received in redundancy payments.
