Morlai*, an African American man, arranged to view an apartment through a real estate agent.
During the viewing, the agent and Morlai had an abusive argument which left Morlai feeling racially vilified by the agent.
Morlai lodged a complaint with ADNSW. When a suitable outcome could not be reached in conciliation, the complaint was referred to the Administrative Decisions Tribunal.
The real estate agent was found guilty of racial vilification as the argument was held in a public place on the balcony and was overheard by neighbours. Morlai was awarded with $2,000 compensation.
