Denied pay increase and employment opportunity

March 2021

Rachel* is a marketing professional and is on parental leave because she had a baby.

Rachel felt that her employer had discriminated against her because of her caring responsibilities while on parental leave. She was not given a remuneration review and the opportunity to act in temporary promotion.

Rachel lodged a complaint with ADNSW.

At conciliation, the employer stated Rachel was not eligible for a pay increase because her salary was already above market range. They also said the temporary promotion role needed to run at the same time as Rachel’s parental leave.

The complaint was resolved, and Rachel received a monetary payment.
