Same sex couple not allowed access to sperm donor

Sandy* and Fran* are a same sex couple who want to have a baby. They went through an IVF clinic to find a sperm donor.

After waiting the IVF clinic’s nine month waiting period, Sandy and Fran were given access to a website that contained the available sperm donors. They were then told that donors were allowed to place conditions on who could receive their donation. None of the donors on the list allowed access to same sex couples.

Sandy and Fran lodged a complaint of homosexual discrimination with ADNSW.

The IVF clinic argued that this was a legal requirement and not part of their policy.

The complaint was resolved when the IVF clinic agreed to publish a disclaimer on their website and in their publications so all prospective clients were aware of this.
