Linh-Bich* had successfully applied for a higher-level role and was placed on a talent pool. After being diagnosed with breast cancer and needing time off for treatment, she wasn’t appointed to the position.
Linh-Bich lodged a complaint with Anti-Discrimination NSW (ADNSW), saying her employer discriminated against her because of her disability.
ADNSW investigated the complaint by seeking information from both parties.
The employer said Linh-Bich wasn’t given the role because she couldn’t work full time at the time, which they said was a requirement for the position. While the investigation was underway, another vacancy came up for the same role Linh-Bich was appointed to that position.
The matter was resolved during a conciliation meeting held via Microsoft Teams. The employer acknowledged that it could have appointed Linh-Bich to the original role and supported her by allowing leave for treatment. Linh-Bich accepted both a verbal and written apology from her employer to settle the complaint.
